The study reconstructs the legal regime of submarine cables through a transversal reading of the regulation of the sea and analyzes the developments of the subma- rine cable industry which today attracts investments from the main global big tech companies. The principle of freedom of the seas, from which the substantial freedom of laying cables and pipelines derives, has favored investments and an exponential growth of infrastructures, overcoming, especially in the communications and data transport sector, the situations of network monopoly on which European regulatory interventions were concentrated. In this new scenario, the continuity and universality of services require new approaches to infrastructure safety on which national and Eu public interventions are concentrated.
